Moses Wetangula sued Danson Mungatana over Sh12 million ‘friendly loan’

Danson Mungatana was once a shining political star from the coast who nicknamed himself "mla mamba", the croc eater, but today dodges creditors, battles auctioneers and skirts from court process servers according to peers in the legal fraternity.
Most can hardly keep up with the frequency with which he changes mobile phone numbers.
Mungatana's debt problems dates back to 2011 when he was separately sued by two businessmen, one who took him to court because a car he sold him had been seized by Equity Bank over a Sh5.6 million debt.
David Mahugu claimed he bought a Range Rover KBG 496K from Mungatana through Murang'a Road Motor mart Ltd at Sh3.8 million in 2010 but the car had been seized unlawfully by Antique Auctions Ltd on Equity Bank's orders.
In the other case, City businessman Francis Mburu claims that the MP failed to repay a Sh4.2 million loan and later ignored written and verbal demands to pay the money.
In 2014, Bungoma Senator Moses Wetangula sued Mungatana over a Sh12 million "friendly loan" he allegedly failed to pay after advancing the money on grounds of oral agreement, but Mungatana denied ever receiving the money.
Wetangula claims that Mungatana issued him with cheques which bounced back over insufficient funds.
In August this year, Mungatana was ordered to repay a Sh7.5 million loan he owes Equatorial Bank in full after the High Court rejected his request to pay the loan in instalments.
The Court ruled that the politician had failed to comply with his earlier plea that required him to pay a monthly instalment of Sh100, 000, hence, his plea would not be accepted.
The court also dismissed Mungatana's claim that he was not able to pay anything more than what he was offering, indicating that the former Assistant Minister was setting his own terms to pay the debt.
